Reduced a EUR 100,000 Property Claim to EUR 30,000
Valdemars Law Firm resolved a complex co-ownership dispute through strategic litigation and negotiations, helping the client acquire the remaining ownership interest while reducing the financial exposure from EUR 100,000 to EUR 30,000.
Background
Our client became involved in a dispute concerning jointly owned real estate after receiving a financial claim exceeding EUR 100,000 from the co-owner.
Following a detailed legal assessment, we concluded that a significant part of the claim was time-barred and that our client also had valid counterclaims relating to investments made in the property.
Our Role
We initially entered into settlement negotiations with the co-owner. However, the negotiations were discontinued by the other party at an advanced stage after they sought a higher financial settlement.
We then made a strategic decision to initiate court proceedings seeking termination of the co-ownership and acquisition of the other party's ownership interest at a reduced forced-sale value.
The commencement of legal proceedings significantly changed the parties' negotiating positions and created the conditions necessary to resume settlement discussions.
Outcome
The parties ultimately reached a settlement under which our client acquired the remaining ownership interest for EUR 30,000, while the original claim of EUR 100,000 was withdrawn.
The dispute was resolved without prolonged litigation, allowing the client to secure full ownership on significantly more favourable financial terms.
