Resolved Cross-Border Software Dispute Without Litigation

Background
Our client became involved in a commercial dispute with a Canadian software company concerning the development, licensing and maintenance of software.
The counterparty refused to pay for the completed development work and licence fees while continuing to use the software. At the same time, it sought to recover additional costs allegedly incurred in adapting the software.
Our Role
Given the cross-border nature of the dispute, litigation would have been both time-consuming and costly. Our objective was therefore to resolve the matter without initiating court proceedings while securing payment of the amounts owed to our client.
We represented the client in negotiations with the Canadian company over a period of ten months, working towards a commercially acceptable settlement.
Outcome
After ten months of negotiations, the parties reached a settlement under which our client received full payment for the services provided.
The settlement enabled both parties to avoid lengthy and costly cross-border litigation.
